Asked 7/21/2016 – Gladewater, TX

He’s on day 86 and still no indictments. Is being held for intent to make and distribute drugs. (1st degree felony charges) he’s wanting to know if they decide to indict at the last minute if he still has the possibility of a PR bond?

Answer

He will have the POSSIBILITY of a personal recognizance bond, but that would be at the discretion of the Judge. Failure to indict within 90 days entitles an inmate to a bond reduction, but not necessarily a PR bond. If your son is indicted within 90 days of his arrest, the initial bond stands but a motion to reduce bond may be filed at any time.
