Asked 8/27/2016 – Houston, TX

I was charged with two counts of robbery w/ bi. When I was on bond for the case my only condition was having random UA screening and report to my P.O. When I was charged with second case a month later and got out on bond I was required to wear an ankle monitor. Just recently in accepted a plea bargain to dismiss my second case and get four years deferred adjudication. I go back to court for sentencing in a few weeks and I just wanted to know if I will still have to wear the monitor when I got the second case dismissed (since that’s the only reason I got on it in the first place) or will I have to stay on during the deferred. I also failed two UA screenings for marijuana, but my bond wasn’t revoked if that would affect it in anyway.

Answer

You probably want to talk with your attorney; prosecutors generally do not dismiss a case as part of a plea bargain until the plea on the other case is finalized, so you may still have 2 cases pending. The ankle monitor is a condition of bond, and once the cases are resolved, the bond is discharged. The only way you would have to continue wearing the ankle monitor after the plea is if it is a condition of probation. Ask about this at your pre-sentence interview with the probation department
