Asked 3/26/2016 – Dallas, TX

For a felony in Texas, if indictment means the formal charge document. What is the ARRAIGNMENT regarded? I have a no-billed case for stalking. Can I say I have been arrested BUT never been charged (because of the no-bill)?

Answer

Arraignment is where you are read the charges against you. Yo will be arraigned after your arrest, told what charges you were arrested for and a bond is set. Once the case is filed, you can waive formal arraignment (reading of the indictment, information or complaint against you), or it can be read into the record. If your case was no-billed by the Grand Jury, then yes, you can say you were arrested but not charged. Contact a local attorney about an expungement.
