Asked 9/1/2016 – Waco, TX

I’ve recently read up on this now and again and I see people posting this is false:
“Sexual assault includes sexual penetration between a minor who is 17 or younger and a defendant who is three or more years older than the victim. This offense is a second degree felony, and penalties include at least two (and up to 20) years in prison.”

Keyword that confuses me is “or”. Which leads me to believe even if being 17, the 22 year old can end up with a sexual assault charge?

Answer

The age of consent in Texas is 17. See Texas Penal Code Section 22.011 0 Sexual Assault and Section 21.11 – Indecency with a Child.
