Asked 6/17/2016 – Conroe, TX

I was arrested I made bond and those are releasing me from jail they make me sign a form agreeing to adult probation until I go to court when I haven’t even been convicted of anything yet just charged it’s not a condition of bond by the bonding company it’s a condition of bond by Montgomery County. I was under the impression that in the United States of America we were innocent until proven guilty and this making me do this is saying the total opposite you know there’s a fifth amendment you know about incriminating ourselves and what they’re asking me to do is give them evidence to use against me myself . that can’t be legal

Answer

Technically, you are not on probation. You must follow conditions of bond that will be supervised by the adult probation department. Judges are allowed to impose conditions of bond (See Article 17 of the Texas Code of Criminal Procedure). The exact conditions which you are objecting to should be discussed with your attorney.
