Asked 8/30/2016 – Huntsville, TX

My boyfriend is on probation for misdemeanor A but now has a new charge (failure to Id with intent to give false information) he goes to court in a few days and his probation officer said it’s likely he’ll get probation. How does that work?

Answer

It is possible to be on probation for separate cases from different counties at the same time. A court has the authority to enter probation, and then have the probation transferred to the county where the probationer resides. In your boyfriend’s case, he must make sure probation will be granted in the new case, and then make sure the probation in his first case will not be revoked. Get with a local attorney.
