Probation IS available for persons charged with DWI 3rd. It is a 3d degree felony, punishable by a fine of up to $10,000, confinement in prison from 2 to 10 years, or a maximum probationary period of up to 10 years. Whether the prosecutor in your case, however, will offer probation in a plea bargain, or if a Judge would grant probation is another matter. Entering in a rehab facility is probably a good start.
