Is it still statutory rape?

Asked 7/27/2016 – Wichita Falls, TX

My friend met a girl and spent a weekend with her. She said she was 20 and had sex with him. A few weeks later he found out she was 16. Is that considered statutory rape?

Answer

Sexual contact with anyone under 17 is an offense, regardless of any representations of age. See Texas Penal Code Section 22.011 – Sexual Assault and Section 21.11 – Indecency with a Child.
