Asked 7/7/17 – McKinney, TX

I’m 16 and want to move out with my boyfriend who is 16 turning 17 can We get someone who is 18 to sign the lease and We pay for everything and the 18 year old doesn’t live with us. Is that illegal? or can we or the 18 year old get in trouble with the law in any type of way?

Answer

Yes, the 18 year old can get in trouble with the law if you attempt to move out as you describe without parental permission. See Texas Penal Code Section 25.06 – Harboring Runaway Child. Your parents have legal control and obligation over you until you turn 18, so you must remain with them until that time.
