Asked 4/19/2016 – Dallas, TX

I just turned 17 in 1996 me and a friend got drunk and came up with a plan to rob a store he had a gun I had a knife we started walking to the store then changed our minds and headed back home then a cop car drives up so we ran and were caught. Still extremely drunk we confessed while be interrogated. We were charged with conspiracy to commit aggravated robbery and evading arrest.

Answer

Voluntary Intoxication nor your age would be a defense to the acts as you describe. The voluntary nature of your confession due to your intoxication MIGHT have been a possible issue at trial, but courts are extremely leery of using intoxication as an excuse for behavior. If your case been resolved either by plea or by trial and a conviction entered, your chances of overturning a judgement on the basis you describe would be slim to none.
