Asked 1/15/2016 – Austin, TX

I got a possession of paraphernalia charge in Texas. I’m not a citizen and my lawyer says that we can aim for a dismissal or a disorderly conduct charge, neither of which have immigration consequenes according to him. Is this true?

Answer

If you don’t believe your attorney, get a new attorney. If your charges will be reduced to a class c misdemeanor disorderly conduct instead of a drug charge, yes, it has far less immigration consequences.
