Asked 6/23/2016 – Corpus Christi, TX

I’ve had the mobile breathalyzer for 5 months. I’ve always paid it on time and had no or failed test. But due to it being slow at work I can’t afford to pay it this month. It being due on the 23rd and I can’t pay it until the 26th. The unit will lock out on the 25th. So I can’t blow until it’s paid. What happens then and will this go against me?

I assume the interlock device on your car is either a condition of bond while your DWI case is pending, or a condition of the probation assessed in your DWI. In either event, not having a working interlock device is a violation of those conditions, and can put you in jail. Go to the court and explain your financial situation to the Judge BEFORE the lockout. Otherwise, if the Court receives notice of the lockout without hearing from you, it will be assumed you are running around drinking and driving again.
