Asked 8/30/2016 – San Antonio, TX

The issue is he is already under deferred disposition for speeding and is completing defensive driving course, alive at 25 course, and 16 hours of community service in addition to having to take the driver’s test again. We have already paid the fine. So he’s already violated the terms by getting another ticket. His probation was set to expire in November if everything was completed by October. What are my options? Can he get another deferred disposition? If not is it even worth finishing the requirements for the first one if he already busted it? Regards.

Answer

There is no statute that prohibits more than 1 deferred disposition in a given period of time; deferred is totally within the discretion of the Court. You may want to call a local attorney to find out the particular policies of the court where your son’s new ticket is pending.
