Asked 5/14/2016 – Plano, TX
I was placed on Deferred Adjudication, and my probation ends tomorrow, which is a Saturday. My officer said he would be closing the case, but I know he does not work on Fridays or Saturdays. My brother and I are planning a trip to Colorado next week and plan on partaking in some “legal” activity, if you know what I mean. My officer said I would not need permission to leave the state after the expiration date. Would there be any possibility for a drug test after the expiration date? Should I wait until I receive discharge papers? My probation is in Collin County.
Answer
Your probation ends on the date of termination stated in the order. After that date, the court does not have any jurisdiction over the case nor the authority to compel you to take a drug test, and neither does the probation department.
