I was arrested for dwi first offense. I was offered a lesser charge of obstructing a highway as a plea deal which would be Classs b misdemeanor, a deferred adjudication offense. My question is, I am a security officer and according to the administrative laws of the Tx. Department of Public Safety ,Texas Penal Code says Obstructing a Highway chapter 42 or any offense in that chapter is considered a disqualifying offense.my question is would I lose my security license by taking this plea deal even if it is deferred adjudication?

Answer

If you successfully complete the deferred adjudication probation, the case will be dismissed. Discuss your employment situation with your attorney, and find out if your security license will be suspended only upon a conviction (which will NOT occur in the situation you describe), or if any plea of guilty or no contest will cause the suspension.
