Asked 7/27/2016 – Pearland, TX

My boyfriend violated his parole by getting a DWI in Montgomery County and he is currently in Brazoria County. He’s been in there for 4 months now, what is the max time he can do in county jail for violating his parole? He waived his rights to a parole hearing, his P.O has been no help to us, and we don’t know what to do or how long he will be in there.

Answer

Your boyfriend is subject to return to prison for the balance of his sentence. If his parole is revoked, he will not necessarily remain in the county jail. Has the DWI been resolved? Parole MAY be waiting on the underlying case, but you would have to contact his attorney to determine the status of the new case.
