Asked 5/14/2016 – Houston, TX
On 4 years probation – been reinstated once when I caught another case.
Felony- Court 179 – Kristen Guiney – Honorable Judge
Test positive for DOC- Meth in my UA at probation –
Was discharged at Substance abuse group for admitting I had relapsed and needed help. My counselor agreed to help me and then the next day, she said her treatment team wouldn’t let her honor the original agreement (be honest about my relapse and face no punishment) because her treatment team had decided to discharge me.
See my probation officer last week of May and I have emailed her multiple times and called and left voice mails twice. NO RESPONSE. Asked if I could go to rehab.
Ive asked her if I can know what the outcome might be so that I can try to hold on to my career. This is a position that doesn’t come around but once with a past like mine.
From my job, my child support is paid, my housing, my vehicle, my health insurance for me and my 3 children among other things.
The judge said if ever I had a problem – she would help me – not arrest me- but how do you get to talk to the judge without a personal appearance to the courtroom where I would risk being arrested. ??? IDEAS?
Answer
1) Eventually, you will have to appear in court. 2) You must face the fact that you may, and probably will be arrested at some point. 3) Your options are limited. You can appear in court ASAP before the motion to revoke your probation is filed and a warrant is issued, explain your situation and see what the Judge does. Or, you can wait for the warrant to issue, get arrested and appear in front of the Judge, explain your situation and hope the fact that you delayed appearing in Court does not negatively affect you. Get with your attorney SOON.
