Asked 8/18/2016 – Collinsville, TX

My husband got arrested here in Texas where he lives for a warrant in Oklahoma. They said he’s being held and Oklahoma has 10 days to come get him will he be able to be released after those 10 days or can they extend the hold like a us marshal hold. Because I know a us marshal hold is 10 days and can be extended up to 3 times is

Answer

Yes, extradition holds may be extended for longer than 10 days. Even if your husband is released before Oklahoma picks him up, there is nothing to prevent a new hold from being issued sometime in the future, which would mean you would have to go through this all over again. Whatever happens regarding the extradition, start talking with attorneys in Oklahoma as soon as you can.
