Asked 1/30/2016 – Pearland, TX

I was going 33mph in a 20mph school zone at Pearland, TX. Actually, the school starts at 8:00 am (all students were in classrooms and no cars were on the school zone street) and I just got out from the school parking lot at 8:20 am. and was stopped by a cop. I haven’t ever gotten a ticket within 3 years and wish I would have known I was in a school zone cause I always go the speed limit. Should I plead not guilty?

Answer

The school zone has to be adequately marked to provide notice that a school zone is in effect; however, if you just left the school parking lot, it might be difficult to claim a reasonable person would not have knowledge they were in a school zone. You may want to contact a local attorney to see what your options are and what can be done to keep this matter from your driving record.
