Asked 3/1/2016 – Lewisville, TX
My wife was charged with shoplifting (first time) for less than 100 USD and asked to come to court within 2 weeks.
1. We want to plead no contest and ask for deferred disposition probation? In this case will they ever go back to the other party and ask for more details. Will this affect civil case by the store.
3. Is it beneficial to go to court the very next day, rather than delaying it.
4. Whom should we contact in the court and what documents to carry
5. She is a housewife, has applied for L2 visa extension, and need to move back to native country after few months. Can this affect her movement back to native country?
Appreciate your valuable advise.
Answer
Due to your wife’s immigration status, CONTACT AN ATTORNEY IMMEDIATELY. This is a crime of moral turpitude, and a conviction on this will, in all likelihood, result in the denial of her visa. There are far reaching, long term consequences in this matter, and I’m sure you can contact a local attorney who will not charge a consultation fee. Talk with counsel before you make any appearance in court.
