Asked 4/14/2016 – Austin, TX

I need to know what are the charges or law’s on possession and distribution of k2 in austin texas….I have seen some people go to jail for selling one joint and I’ve seen some people with a backpack full of bags of k2 and is just written a ticket and there k2 just thrown away so I’m confused

Answer

The penalty range for controlled substances is found in the Texas Health and Safety Code Section 481. The punishment levels differ between possession and manufacture/delivery and also depend on the weight of the substance. The bottom line is depending on the amount of K2, a person could be charged with a class c misdemeanor punishable by fine only if there is not a usable amount of substance, up to a first degree felony, punishable by prison sentence from 5 to 99 years.
