My sister in law was arrested during a traffic stop and is being charged with a drug offense that will more than likely result in jail time. When she was pulled over she did not have my 3yr old nephew, she had left him with “friends” my mother in law picked him up and has had him for over a month now. Legally what can she do? Or should she have called CPS before picking him up? Or should she call CPS now? The father is out of the picture.

If your sister is going to jail, someone needs to be appointed guardian of the child. You may contact CPS, but once they are in your lives, it is very difficult to get them out. Contact a family law attorney about your nephew’s situation.
