Asked 2/10/2016 – Austin, TX

My best friend is currently incarcerated in the TDCJ. He is trying to appeal his conviction, but he does not have the money to retain an attorney and the appeals court will not provide him one.

Answer

Your best friend is not entitled to a court appointed attorney on appeal. The Innocence Project is one avenue he can pursue, and he may contact any pro bono legal services in the area, Other than that, he must pursue a writ of habeus corpus on his own if he does not have the funds to retain his own attorney.
