Asked 5/12/2016 – Georgetown, TX

I was at a house that was raided. They searched my purse and wallet. They took my cell and laptop yet neither are listed in my report or inventory. They threw 2 flash bangs even though they had a no knock warrant. Refused medical treatment, and had me in handcuffs for 7 hours outside before taking me to the station. All of the reports are messed up. wrong address, times, and officers involved. I have a court appointed attorney who has not done anything. Please help. I can’t afford an attorney. I don’t know what to do

Answer

You did not state what you are charged with and where you are in the process. Has the case been indicted? Are you looking for the return of your cell phone and laptop (those items may be potential evidence, and will not be listed in your personal inventory)? What was found in your purse and wallet? Are you the owner of the house that was raided (you may not have standing to file a motion to suppress)? The bottom line: there MAY be issues that can be raised in your defense, but without specifics, nothing you list above suggests law enforcement did anything incorrectly. An attorney will have to review the procedural aspects of the case to determine if anything can be filed in your defense. I suggest you focus on 1) what you are charged with and, 2) are those allegations true. Your attorney cannot make up the facts.
