My probation was revoked Wednesday and a warrant will be issued for my arrest. I plan on turning myself in and bond out but first I am going to work for as long as I can to save up for a lawyer. Next month was my last month and I did not show up to my probation because I didn’t have the money to pay it off. So a warrant was going to be issued anyways plus I lost transportation at the last minute. My question is, if I was to get a lawyer, how can that help me to get no jail time. I just got a job and I have been in no trouble. My ex is abusive and I really can’t have my baby go there. I want to take care of this situation so what can I do to receive no jail time? And can I receive additional charges?
Answer
From what you describe, your probation has not been revoked YET, but the process has begun. Ideally, you could get all monies due to probation and the court, pay the total amount of the sums due, then appear in court and ask the Judge to deny the motion to revoke since the allegations in the motion are no longer applicable. This assumes that the only reason for the revocation is failure to pay fines, costs or probation fees. If there are any other reasons why your probation can be revoked, you will have to retain an attorney and appear in court. What will happen to you depends on the allegations, and the recommendation of the probation department.
