My boyfriend was arrested in August for something he didn’t do . He is Currently on parole and we’ve already had the preliminary hearing where 2 witnesses stated he was no where near the place of crime. they’ve charged him with the charges but have no evidence . What are the next steps why are they holding him so long without any court dates or revocation hearings ? Are they just screwing with us?
Answer
If your boyfriend is on parole, he is facing 2 separate proceedings, the new charge and the parole violation. You state witnesses appeared at the preliminary hearing; I assume this was on the new charge. I need to know if this is correct or if witnesses appeared at the parole hearing or before the Grand Jury. If your boyfriend has been in jail since August, I’m certain an attorney has been appointed to represent him Ask that attorney if the case has been indicted, if a copy of the officer’s arrest affidavit is available and if any other evidence has been obtained, so you can at least know the allegations the State us making.
