Asked 2/8/2016 – Austin, TX

I was pulled over and charged with a POM greater than 2oz but less than 4oz. Class A misdemeanor. I had a previous POM that was dismissed.

You should retain a local attorney. Please remember that everybody on the planet who is charged with a criminal offense wants their case dismissed, but you can’t always get what you want. There are no facts provided about your situation that give an indication why your case should or should not be dismissed, so discuss the matter with your attorney in detail. The fact you have a prior possession case may be an issue, depending on how the 1st case was dismissed (were you found not guilty, or was the case dismissed after you completed some type of program). Since this is your second go-around, some options may not be available to you this time.
