Asked 3/15/2016 – Corpus Christi, TX

I’m on 3 years differed adjudication.
In the past 2 years of me being on probation. I haven’t committed another crime, I’ve been abiding by my rules. Curfew, no alcohol, no drugs. All urinary analysis have come back negative.

I’ve only paid 130 in the past 2 years. And haven’t done my 120 hours of community service yet.
I asked my probation officer for a transfer, and she told me she doesn’t feel comfortable sending a high risk case over there; to my home town of Sinton Texas. It’s a small town. So I can get stuff done here. I’m with family. The probation office is right down the street. I don’t have to worry about money, or eating because my family is going to take care of me, as suppose to my previous living situation where it was dog eat dog. If I didn’t eat, my dad didn’t care. Drugs where his life. And he chose that. I got kicked out, and failed to report twice.

Now my probation officer wants to schedule a review in front of the judge. She mentioned I’m facing up to 3 days in jail.

I just moved into a great environment.
Starting fresh, and was about to complete this probation in my last year. Sinton is a safe place for me.

Answer

When you signed up for probation, you agreed that in exchange for not going to prison and then potential of not having a conviction, you would abide by the terms of the probation order INCLUDING community service, residing in the county assigned and paying fines and costs. You don’t get to change the terms of the deal, only the Judge does. Tell the Court your story and pray for benevolence. You should talk with the attorney who helped you with your original plea before you appear in court.
