Asked 1/28/2016 – Harlingen, TX

I have city tickets which turned into warrants in Harlingen TX for no driver license and according to my bill of rights I don not need to obtain a valid driver license for traveling only if I was committing commerce then I would need one but I do not sell things I only take my wife to work and my kids to school or look for employment.

Answer

There is nothing in the Bill of Rights that mentions a driver’s license; the automobile was not invented for over a century after the Bill of Rights was adopted You are correct about the State not being able to force you to have a driver’s license. You also do not HAVE to operate a motor vehicle on a road provided by the State If you are on your own property, no license is required to operate a motor vehicle. If you are on a public street or highway, a license is required to drive a motor vehicle (believe me, you are not the first person with this argument, its gone through the courts, you won’t win). Get a local lawyer to post bonds and see what your options are.
