Asked 1/22/2016 – Longview, TX

What can I do? Set-Aside or Seal my Conviction from 10/07/2005 Guilty Plea of Arson, 2nd Degree.
5 Years completed probation
200Hours of Community Service Completed
I am desperate to get this sealed for employment purposes… Can anyone help?

Answer

If you were given straight probation, and a guilty finding was entered at the time of the plea, the only way to remove this matter from your record is bu pardon from the Governor. If you were given deferred adjudication probation, you successfully completed the probation and the case was dismissed pursuant to the deferred adjudication agreement, then, after 5 years have expired from the date of the dismissal, you can petition the court for an order of non-disclosure.
