Asked 7/8/2016 – San Antonio, TX

I was followed home by an undercover officer in Texas, who didn’t pull me over but got out of his car to talk to me when I parked at my apartment. He said he clocked me going 115 (stupid, I know. There’s somewhat of a reason but I’ll spare the excuses) at about 1:30 AM on a mostly empty highway. He got my license, ID, came back and said ‘you’ll be hearing back’ and then left. I assume I’ll be arrested soon for reckless driving at the minimum. That was almost 2 weeks ago, I haven’t heard anything back yet but I keep checking online for arrest warrants.

What can I expect as my outcome? I am 22, have no prior record and have never been ticketed or even pulled over before. I am in good standing with community and am employed locally. I fear jail time very much, that would destroy my career prospect and wreak havoc on me emotionally. Really all I want to know is, is there any chance I can get off on this with a large fine and probation or some alternative? I spoke with a few local attorneys and one says I should put down $1000 for a retainer, another said just wait until I’m arrested and then call back. I also want to avoid the humiliation of being arrested while at work.

Answer

Since you do not know if any charges will be filed against you, and if any are filed, what the charges would be, it is impossible to tell you what to expect. Find out the phone numbers to the warrant division for both the county Sheriff’s office and the police department of the officer who stopped you. Check with them periodically to see if a warrant has been issued. If you discover one is outstanding, contact a local attorney. Until then, you have to sit and wait.
