Asked 2/2/2016 – Houston, TX

I am on deferred adjudication probation for aggravated assault of a family member. I got arrested for family assault 9 months in to my probation I’ve been struggling money wise to pay my fees and pay to get into domestic violence class and only have done a few hours community service due to my high risk pregnancy I have high blood pressure doctors told me to stay off my feet. My p.o told they’re going to issue a warrant for my arrest in a few weeks for violation.

Answer

Go see the Jude BEFORE the warrant is issued and explain your financial situation. Only he/she has the authority to waive all or part of your fees and to modify the conditions of probation. If you just wait for the warrant to issue without addressing your problems, the court will more than likely feel you are avoiding your responsibilities and will not be sympathetic towards your case. Go up to court TODAY. Bring proof of what you have completed and what you have paid. Tell the court coordinator that you need to speak with the Judge about your probation, and you need help to successfully fulfill your obligations.
