For a 3rd DWI felony case in Texas: For the past several court dates there were “pass slips” documents with the “Announcement” box checked and a continuance date and sometimes a plea offer. This time, the document was named “Jail Dispo”, the box “Discovery” was checked, and the following plea offer was written: “10/8 yrs + 10 cond. std DWI repeat offender +$2,000”.

Answer

The DA plea recommendation is a 10 years jail sentence probated for 8 years (meaning he will be on probation for 8 tears, but if he violates his probation, he will go to prison for 10 years). He will have to serve 10 days in the county jail as a condition of probation as well as complete all the standard DWI repeat offender classes and conditions (ask his lawyer). The fine recommendation is $2,000.
