Asked 1/28/2016 – Denton, TX

My boyfriend violated his probation is in Denton County Jail in Texas. Case #F-2009–0225-c. Charges: motion to adjudicate guilt and poss cs pg 1He finally has a court appointed attorney, but has limited communication with her. She has not responded to any emails sent. On February 20, 2016 there were 3 motions filed. The first was a motion to dismiss (state’s motion to revoke), 2nd was to dismiss (states motion to proceed with adjudication of guilt), and the 3rd was to set bail or bond). All of which state that the proposed order will not be signed. He has an announcement on February 1, 3016 at 8:30am.

Answer

Who filed the motions to dismiss, your boyfriend’s attorney or the State? (I assume these motions were NOT filed 2/20/2016) If the motions to revoke are dismissed and a bond is set on the new case, your boyfriend may be able to be released while the new case is pending, if he can post the bond assessed on the case. Now, I’m just guessing because I have no idea about the actual details that the prosecutor and defense attorney have discussed. Don’t wait on an email. Call the attorney’s office, set up an appointment, sit down and discuss the matter.
