Asked 8/16/2016 – Temple, TX

Family member violated Missouri Probation conditions by coming to Texas. Allegedly, he had an altercation with an ex-girlfriend. Initially, she filed a report that another ex- assaulted her. But after she learned of another girlfriend of my family member, she identified him as assailant. Long story short, once he was apprehended, his fugitive warrant from Missouri was discovered. On 26 August 2015, our family posted bond on The Texas Assault Charge. Until this day he is still in jail. We were under the impression that if Missouri didn’t extradite, he would be released by now. Has this ever happened in the past? What type of relief can our family member get? Thanks

Answer

You should have a local attorney find out the status of everything. A year is too long to await extradition. Was extradition waived or contested? Has there been a hearing on the matter? Has anyone contacted an attorney in Missouri? Talk with local counsel first.
