Asked 1/25/2016 – Houston, TX

My friend was arrested once she arrived to Houston airport for probably ion violation in another state (Colorado) she had a warrant back in November so when arrested here the charges were for out of state fugitive, I just want to know what it means when her status says “Realeased to hold for Another Agency” did they send her back to Colorado? And why does her court appear to still be in Houston if so?

Answer

Since there was a warrant out for your friend, she was subject to arrest by any law enforcement agency. The officials at the airport then had the right to make the arrest, send her to a local detention facility, then notify the agency who issued the warrant to come pick her up. She should have an attorney appointed for her in Texas (or she can retain her own attorney) and the only question in the Texas court would be if she will fight being transferred to Colorado (extradition). If and when she is sent to Colorado, she will need an attorney licensed in that state and the case against will proceed from there.
