Asked 7/27/2016 – Fort Worth, TX

My son was asked not to go back to a store and he went back and cops were called and he was arrested for criminal trespass. This is his 2nd time being arrested for same charge at same store

Answer

Criminal Trespass is generally a class b misdemeanor, punishable by a fine of up to $2,000, confinement in jail for up to 180 days or a maximum probationary period of up to 24 months. Under certain conditions, however, trespass can be a class c or class a misdemeanor (See Texas Penal Code Section 30.05). If your son has a prior conviction, punishment ranges can be enhanced, so contact a local attorney.
