Asked 6/20/2017 – Austin, TX

My wife was just approved for Parole from a Tdcj facility, but she has a felony hold from Missouri, What is the time limit for Missouri to come get her?
She signed the consent for extradition form months before already.

Answer

The Statute of Lu imitations does not apply to your wife’s situation. Extradition is governed by Article 51 of the Texas Code of Criminal Procedure, in particular Article 51.13. Expect 90 days, but you may want to contact an attorney in Missouri; if your wife has already served her sentence in Texas and the warrant from Missouri has been pending during this time, all the time she spent in jail in Texas will be credited towards any sentence in Missouri. An attorney in that state MAY be able to convince a Judge and/or prosecutor that it is not worth the time and effort for extradition.
