Asked 6/21/17 – Temple, TX

Sexual assault. Already did a few months in jail. Open plea pending. Wasn’t any injuries of the victim but there was “age difference” etc. Is it possible for the victim to bail the defendant once the case is over or case is pending?

Answer

I am not sure what you mean by “Is it possible for the victim to bail the defendant…”. You need to ask this question to your attorney. If your case is set for open plea, you should know the entire range of punishment is available to the Judge in assessing your sentence. When you say sexual assault, you would normally think of a second degree felony, but when you make the statement of “age difference”, you may be talking about another degree of felony. Get with your attorney, review the indictment, find out exactly what you are charged with and what you may be looking at.
