What is the motion called when a person receives a no bond for prior convictions and after 7 days they are entitled to a hearing

Someone is being held with no bond. For about 4 weeks now. Is this legal? He isn’t on bond, parole, probation….

Answer

The type of motion that needs to be filed depends on what status the case has pending. A writ of habeus corpus may be required, or a simple bond hearing may be necessary. Contact a local attorney and go from there.
