My husband has been served with a governor’s warrant from Harris County Texas. It took 60 odd days to get this approved, and he was served about a week ago. We are wondering if this is an end-all be-all for the situation or if there are more channels of approval and procedures to this process. How long does it typically take to arrange this type of transport? Does the funding need to be approved before transport is dispatched? What are the steps this will go through now, if any? His initial crime was misdemeanor DV for which he received probation. He never reported to his probation officer, not even one time resulting in a violation. That’s what the state of Nevada is currently holding him for. Texas now has about 19 days left to come get him. I was told there’s no way they’ll arrange a special trip just for him, that there must be others here the need to go back to Texas here. I just want someone to shed some light on the process after a governor’s warrant has been served please.

Answer

There is no typical time to arrange interstate transport of a prisoner. You husband will remain in custody until Texas picks him up, or until Nevada gets tired of holding him (after 19 days). This is a logistical and scheduling issue for law enforcement not a legal issue. If you husband is not transferred in 3 weeks, you may have to contact an attorney in Nevada regarding a writ of habeus corpus.
