Asked 7/18/17 – Dallas, TX
I am under the impression I was given a ticket for an open container Jan 7th 2007. I was extremely intoxicated from a party in which I passed out and I was riding home with some friends. I only remember the situation because my friends told me I literally fell out of the car when the officer asked me to step out. Then fell again when I made it to my feet. I never had the ticket in my possession, to my knowledge. They are now saying I owe $512 for the fine. I am hoping the SOL has expired this ticket.
Answer
The statute of limitations is tolled upon the filing of the charging instrument with the court. This may or may not have been done in your case, so contact an attorney in the city where the ticket was/is pending to determine the status.
