My son was arrested on September 30th for aggravated bank robbery. He’s at the county jail but has not been charged or indicted. He’s been in jail since September 30, 2015.

Answer

The statute of limitations for an aggravated robbery case in Texas is 5 years. (See Texas Code of Criminal Procedure, Article 12.01 (4)(A) and Article 12.03 (d)). However since he has not been indicted, you don’t know exactly what the charges will be. If your son has been in jail that long, he should have an attorney appointed to represent him Contact that attorney to determine the delay.
