Asked 3/23/2016 – Edinburg, TX

I was arrested for possession of marijuana Class B last year before I finished high school. I admitted to the possession of the substance to police when then arrived, I submitted an acceptable P.T.D. application but was denied due to date submitted was after arrangiment. I have three options.
Guilty plea, fight the case, or ask for reconsideration.

Answer

The statute of limitations is tolled when the charging instrument is filed; delaying the case will not result in a dismissal. Get an attorney. Let that attorney review the evidence and provide an opinion. Fight the case if you are not guilty. Plead the case if you are.
