Asked 2/5/2016 – Shiner, TX

My probation has been revoked. The warrant has ten violations. the violations against me are petty at best. Only this preponderant thing worries me. I think it means that I can be revoked based on an assumption. That doesn’t seem very fair to me. Well I guess nothing has been fair or legal since the day I was arrested. I have paid the delinquent fines, I have more completed 225 comm serv hours. I am suppose to do 8 a month and it’s been 10 months so that’s three times the amount mandatory. I have satisfied the court and completed drug offender class. They said I refused a UA but I did not. I know can’t prove it but I honestly begged for alternative testing due to IBS and I was denied. When I return for next meeting my po said I refused alternative which was another lie. She told me not to do any comm serv hours I guess she had been planning my revocation since day one. They made a mockery of my IBS in the office and refused to let me clean my self or cover my self after I had an accident. Basically I have done everything they asked me to do except sign there refusal form and turn my self in to ISF the violation of refusing when I know I was clean.

I hope you have retained an attorney who can go over each of the violations and prepare a defense for each one. I know you think these matters are petty, but ANY violation can send you to prison. Please do not appear at the hearing by yourself with the attitude that your are right, the probation office is wrong, and the Judge will see you as a victim. Remember, you were the one that had the evidence against you that substantiated your guilt, so you will NOT receive the benefit of the doubt. If the State proves ANY of the violations, you are in trouble.
