Asked 8/16/17 – Corpus Christi, TX
Someone ask me to fix his motorcycle, I fixed it, and he let me use it for a few days. I was pulled over, and the officer told me it was stolen. Now I have been charged with unauthorized use of a motor vehicle.
I don’t have any kind of criminal record at all, I didn’t steal this bike. Any information about this would be greatly appreciated.
Answer
You will have to retain an attorney, appear in court as directed and answer the allegations filed against you. A person commits an offense if he intentionally or knowingly operates another’s boat, airplane, or motor-propelled vehicle without the effective consent of the owner (see Texas Penal Code Section 31.07), so the fact that you personally did not steal the motorcycle is not an absolute defense. This is a state jail felony, so start talking with local lawyers soon.
