Asked 4/26/2016 – Greenville, TX

OK I was out on a PR bond for a felony case but they let me out on a PR bond with the case still pending which made me follow some conditions of reporting every week with a UA my charge doesn’t have anything to do with drugs. I ended up catching a new charge resisting arrest and they’ve now put a warrant out for my arrest for catching a new charge on PR bond. I’m going to be turning myself in because I’m just now finding out and I’m really trying to find out how long will I have to stay in jail and what they are going to do I’m hoping I get offered probation or something.. Because I really can’t go to jail I am a nursing mother and I’m really scared of them trying to offer me nothing but time…

Answer

You have short term and a long term issues to deal with.

Short term: there is a warrant out for your arrest. It will remain outstanding until you are arrested. After you are arrested, you will remain in jail until a bond amount is set on both cases and an appropriate bond is posted. Unless you are unable to post bond, your cases will not be finalized while you are in jail. It is discretionary with the Judge on what the bond amounts will be. I am fairly certain that if you tell the court you “really can’t go to jail”, the Judge will say you really shouldn’t commit new offenses while out on bond.

Long term: you have two criminal cases pending against you. How those cases will be resolved depends on the allegations, the evidence the State has against you, your prior criminal history and several other factors. You will have to retain an attorney to review your cases and advise you on how to proceed.
