I am filing a “Petition for Non-Disclosure”, pro se. With it, I must include an “Order Prohibiting Disclosure”. The wording for the order is extremely important to me, as I currently have somebody harassing me with making this offense public. I am aware that certain internet companies buy this information and I may include them in the order, however, they don’t always comply. My question is, can I include said person in my order prohibiting disclosure? AND, if such record has been obtained or purchased by anyone before it is granted (IF IT IS) what wording can I use to have said person dispose of it, or not be allowed to disclose it?

Answer

Individuals are not subject to the order of non-disclosure; people can talk about you all they want. The order deals with governmental agencies (and companies in the background check business). You may speak with a local attorney, however, about what you can do about this third party and if the level of these threats rises to the level of extortion.
