My husband is a disabled Parkinson’s disease patient and has a deep brain stimulator implanted in his brain. He was hit in the back of his head by an angry stranger for forgetting to put up his disabled placard on windshield. My husband made a police report and we are going to file charges. We want to know if we have a chance of getting compensation. He is not hurting but we were both very scared and worried about the damage if any to his brain and the stimulator. He may hurt tomorrow. We will call his doctor tomorrow morning. 8/15/16
Answer
It is up to the State to file criminal charges, but if an individual files a report with the police, a criminal case can be pursued if law enforcement determines the evidence is sufficient. For monetary compensation, however, you will probably have to contact a personal injury attorney to file a civil suit
