Why is my brother on probation if he hasn’t even been found guilty he was charged in Texas with aggravated sexual assault on a minor and he is having to see a probation officer once a month and they say he can’t even see the mother of the child can they do this and how can they do this what happened to innocent until proven guilty and he did not do this by the way all medical exams on the child and DNA has come back negative and they have nothing and the child’s statement has changed several times so why is he on probation?
He bonded out. But still I don’t understand this at all.

Answer

I realize this can be confusing, but your brother is not on probation. A Judge has the right to impose condition of bond if a defendant is released from jail while his/her case is pending. The county probation department is the agency who will monitor the conditions of bond, so your brother will report to the probation department, but it is to monitor the conditions of bond, not as a condition of probation.
